Probate & Administration of Estates

When a loved one passes away it is often a difficult and emotional time and if you have been named as executor in a will this can add to the stress. Our compassionate and experienced team of solicitors can help guide you through the legal requirements and process to ensure the estate is wound up and administered as quickly and efficiently as possible.
Estate Administration is the process of distributing assets of a deceased persons estate to their beneficiaries. If you have been named as executor in a will then you have legal obligations that you must adhere to. These obligations include arranging the funeral, protecting the deceased’s assets, ensuring estate debts are paid, properly identifying beneficiaries, selling estate assets, considering the tax issues of the estate, ensuring both the deceased and estate tax is paid, distributing the estate assets in accordance with the will and defending any claim that is made against the estate.
You may also be required to obtain Probate of the Will so that you can deal with the assets of the estate.
What is Probate?
Probate is obtained by making an application to the Supreme Court and is a document issued by the Supreme Court that recognises a person’s authority to deal with the estate of the deceased. Most ‘asset holders’ (such as banks or superannuation funds) will require this document before they agree to release a deceased’s assets to an executor.
We can help you with all facets of Estate Administration and Probate and in doing so will make sure that you are protected from personal liability, whilst acting in the role of executor.
Letters of Administration
If your loved one dies without a will (known as dying intestate) or the executor appointed under the will has died or is no longer able or willing to act, our team can give advice and help you obtain Letters of Administration.
Letters of Administration is obtained by applying to the Supreme Court and is a document issued by the Supreme Court that appoints an eligible person to administer the deceased person’s estate.
The court appointed person is known as the Administrator (and has a similar role to an Executor).
Who will inherit if there is no will?
When the deceased didn’t leave a will, the Succession Act 1981 (Qld) will determine who will inherit and in what proportions. Our experienced team of solicitors can provide advice on who will inherit from the deceased and what share they will receive.
Is your estate plan up-to-date?
We offer a free, 20 minute no-obligation review of your existing Will and Enduring Power of Attorney to check whether these documents reflect your current wishes.
